Privacy Policy for Users who Register or Sign Up for a Buymore/Duka POS Account

The Privacy Policy describes the information Buymore Limited (collectively, “Buymore,” “we,” and “us”) collect when a person or business (“you,” “your”) registers or signs up for a Buymore POS (“Duka,” “Salon,” “Bar,” “Retail,” “POS”) account; accesses or uses in any manner a Buymore POS product, service, feature, web/mobile application, website, or technology (collectively, “Services”); or chooses to interact with or contact us www.buymore.co.ke/#contact.

Consent and Scope Extent

By applying or signing up for a POS account, including through a computer or mobile device (“device”), you accept the terms of this Privacy Policy and consent to our collection, use, disclosure and retention of your information as described herein (including to contact you), and for all other purposes permitted under applicable personal information privacy statutes, credit bureau reporting rules, anti-spam legislation, and consumer protection laws.

Amendments to this Privacy Policy

We may amend this Privacy Policy from time to time by posting a revised version and updating the “Last updated” date above. The revised version will be effective at the time we post it. We will provide you with reasonable prior notice of substantial changes in how we use your information, including by email at the email address you provide. Where these changes would cause material detriment to you, you may of course cancel your account at any time. We encourage you to review this Privacy Policy whenever you use our Services to stay informed about our information practices and the choices available to you and to contact us if you have any questions about these changes. Your continued use of our Services constitutes your acceptance of any amendment of this Privacy Policy.

Collection of Information

Our Services can be used by a wide range of businesses in connection with their products, services, activities and administrative functions. We serve retail industries, wholesalers, suppliers, dealers, manufacturers, service businesses (restaurants, liquor stores, bars, wines and spirits, salons and beauty spas), just to mention a few. Likewise, a wide range of information ( including information about you) may be uploaded to or sent through our Services.

We may not be able to provide you the Services or the support you request without having information about you.

Our website and Services are not targeted at minors (as recognized by the Laws and Constitution of the Republic of Kenya) and hence or otherwise do not knowingly collect or store any personal information from minors (an individual of sound mind who is below the age of 18)

Information We Collect

Buymore receives or collects information when we operate and provide our Services, including when you install, access, or use our Services.

    Buymore receives or collects information when we operate and provide our Services, including when you install, access, or use our Services.:

    • Your Account Information. In order to create a Buymore POS Account, you provide information such as business name, type of business, location of business/outlet, contact person (name, email address, mobile /phone number
    • Information about products and services you sell (including inventory, pricing and amongst others )
    • Information about your business employees/staff and their contact information, commissions negotiated, Mobile Payment Account details for processing payments
    • Information about your customers and suppliers (contact details, items supplied to you)

    Some of the information collected about your customers and suppliers is to help you best serve them and or do business with them.

  2. Information Automatically Collected from Your Use of our Services

    • Usage and Log Information. We collect service-related, diagnostic, and performance information. This includes information about your activity (such as how you use our Services, how you interact with the features in our Services, and the like), log files, and diagnostic, crash, website, and performance logs and reports
    • Transaction Information. When you use our Services to make, accept, request or record payments or make a sale, update your stock, we collect information about when and where the transactions occur, the names of the transacting parties, a description of the transactions, the payment or transfer amounts, and the devices and payment methods used to complete the transactions.
    • Device and Connection Information. We collect device-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, browser information, IP address, mobile network information and device identifiers. We may collect device location information when the device initiates a data sync process in the background and if you chosen to enable device location option.
    • Cookies. We use cookies to operate and provide our Services, including to provide our Services that are web-based, improve your experiences, understand how our Services are being used, and customize our Services. For example, we use cookies to provide Buymore POS for web. We may also use cookies to understand which of our FAQs are most popular and to show you relevant content related to our Services. Additionally, we may use cookies to remember your choices, such as your language preferences, and otherwise to customize our Services for you.
    • Status Information. We collect information about your online and offline status of your device when using our Services, such as whether you are online (syncing data), when you last used our Services (your last transaction recorded and synced), and when you last took the device online.
  3. Information we Collect from Other Sources

    • Information Others Provide About You. We receive information other users provide us, which may include information about you. For example, when other users you know use our Services, they may provide your phone number from their mobile address book (just as you may provide theirs), or they may send you a message or an email.
    • Third-Party Providers. We work with third-party providers to help us operate, provide, improve, understand, customize, support, and market our Services. For example, we work with companies to distribute our apps, provide our infrastructure, delivery, and other systems, supply map and places information, process payments, help us understand how you use our Services, and market our Services. These providers may provide us information about you in certain circumstances; for example, app stores may provide us reports to help us diagnose and fix service issues.
    • Third-Party Services. We allow you to use our Services in connection with third-party services. If you use our Services with such third-party services, we may receive information about you from them. Please note that when you use third-party services, their own terms and privacy policies will govern your use of those services.

How We Use Information We Collect

We use all the information we have to help us operate, provide, improve, understand, customize, support, and market our Services in manners such as:

  • Processing or recording payment transactions especially carried out via Mobile Money platforms
  • Displaying historical transaction or order processing, stock update information
  • Developing new products and Services; and
  • Delivering the information and support you request, including technical notices, security alerts, and support and administrative messages

We may use information about you to improve, personalize and facilitate your use of our Services. For example, when you sign up for a Buymore POS account, we may associate certain information with your new account, such as information about other accounts you had or currently have with Buymore, and prior transactions you made using our Services. We also may use information about you to measure, customize, and enhance our Services, including the design, content, and functionality of our applications and websites, or to track and analyze trends and usage in connection with our Services.

We may use information about you to send you news and information, or to conduct surveys and collect feedback, about our Services and to communicate with you about products, services, contests, promotions, discounts, incentives, and rewards offered by us and select partners, based on your communication and usage preferences and applicable law. We also may contact you to resolve disputes, collect fees, and provide assistance for problems with our Services or your Buymore POS account.

We may use information about you:

  • To protect our rights or property, or the security or integrity of our Services;
  • To enforce the terms of our General Terms or other applicable agreements or policies;
  • To verify your identity and legality of your business entity
  • To investigate, detect, and prevent fraud, security breaches, and other potentially prohibited or illegal activities;
  • To comply with any applicable law, regulation, legal process, or governmental request;
  • For any other purpose disclosed to you in connection with our Services.

We may, and we may use third-party service providers to, process and store your information in Kenya, United States, Europe and in Asia.

Safety and Security. We verify accounts and activity, and promote safety and security on and off our Services, such as by investigating suspicious activity or violations of our Terms, and to ensure our Services are being used legally.

Your Information Privacy. We provide our Services to any user who agrees to this Privacy Policy. In the process, we may sign up or register users who may be your competitors in the same industry; we do not share your information trade secrets, ideas, processes (collectively, “business information,” or “information”) with either user. Your business information remains private and safe and we ultimately put you in control of it. You’re solely responsible for information you share with your employees/staff such as access usernames and passwords and device PINs.

Safety and Security. We verify accounts and activity, and promote safety and security on and off our Services, such as by investigating suspicious activity or violations of our Terms, and to ensure our Services are being used legally.

No Third-Party Banner Ads. We do not allow third-party banner ads on Buymore POS. We have no intention to introduce them, but if we ever do, we will update this policy.

No Affiliation or association with KRA. We do not share or expose your information to the Kenya Revenue Authority. We are in no way associated with them. We retain that right to you as the owner of the transactional data about your business.

Information You and We Share

You share your information as you use and communicate through our Services, and we share your information to help us operate, provide, improve, understand, customize, support, and market our Services.

  • Account Information. Your phone number, contact name, business name may be available to specific users who use our Services, although you can configure your Services settings to manage certain information available to other users. For example if you’re registered as a retailer, a supplier may need your business location details in order to fulfill a purchase order you make through the Buymore POS; likewise if you are registered as a supplier or a manufacturer, a retailer may need your contact information and access to your pricing information at the time of making a purchase order.
  • Your Contacts and Others. Users with whom you make stock orders from (e.g suppliers or manufacturers) may store or reshare your information (including your phone number or business name) with others on and off our Services.
  • Third-Party Providers. We work with third-party providers to help us operate, provide, improve, understand, customize, support, and market our Services. When we share information with third-party providers, we require them to use your information in accordance with our instructions and terms or with express permission from you.
  • Third-Party Services. When you use third-party services that are integrated with our Services, they may receive information about what you share with them. For example, if you use a data backup service integrated with our Services (such as Dropbox or Google Drive), they will receive information about what you share with them. If you interact with a third-party service linked through our Services, you may be providing information directly to such third party. Please note that when you use third-party services, their own terms and privacy policies will govern your use of those services.
  • Our Business. We may also share your information in connection with, or during the negotiation of, any merger, sale of company stock or assets, financing, acquisition, divestiture, or dissolution of all or a portion of our business;

We also may share aggregated information with third parties that does not specifically identify you or any individual user of our Services.

Managing Your Information

  • Personal Information. You may access, change, or correct information about you by logging into your Buymore POS account at any time or by making a request to us using the contact details below, in which case we may need to verify your identity before granting access or otherwise changing or correcting your information.
  • Deactivating/Deleting Your Account. If you wish to delete your Buymore POS account, you may do so by logging into your Buymore POS account or by emailing us using the contact details provided below. Buymore generally retains information about you only as long as reasonably necessary to provide you the Services. However, even after you deactivate/delete your Buymore POS account, we may retain archived copies of information about you and any transactions or Services in which you may have participated for a period of time that is consistent with applicable law, or as we believe is reasonably necessary to comply with applicable law, regulation, legal process, or governmental request, to prevent fraud, to collect fees owed, to resolve disputes, to address problems with our Services, to assist with investigations, to enforce our General Terms or other applicable agreements or policies, or to take any other actions consistent with applicable law.
  • Location Information. In order to provide certain mobile app features, we may require location information, so if you do not consent to collection of this information, then you cannot use our corresponding Services. You can stop our collection of location information at any time by changing the preferences on your mobile device. If you do so, some of our mobile app features will no longer function. You also may stop our collection of location information via mobile application by following the standard uninstall process to remove all Buymore mobile applications from your device.
  • Cookies. We try to make your experience with Buymore POS simple and meaningful. When you access or use the Services, our web server may send a cookie to your device. Certain cookies we use last only for the duration of your web or application session and expire when you close your browser or exit the application. Other cookies are used to remember you when you return to use the Services and, as such, will last longer. We may use cookies to:
    • Remember that you have visited us or used the Services before. This means we can identify the number of unique visitors we receive, which allows us to make sure we have enough capacity to accommodate all of our users.
    • Customize elements of the promotional layout and/or content of our website or application.
    • Collect anonymous statistical information about how you use the Services (including the length of your web or application session) and the location from which you access the Services, so that we can improve the Services and learn which elements and functions of the Services are most popular with our users.

    Some of the cookies used in the Services are set by us, and others are set by third parties who deliver services on our behalf.

    Most web and mobile device browsers are set to automatically accept cookies by default. However, you can change your browser settings to prevent automatic acceptance of cookies, or to notify you each time a cookie is set.

Please note, however, that by blocking or deleting cookies used in the Services, you may not be able to take full advantage of the Services.

  • Do Not Track. Do Not Track (“DNT”) is an optional browser setting that allows you to express your preferences regarding tracking across websites. We currently do not respond to DNT signals. We may continue to collect information in the manner described in this Privacy Policy from web browsers that have enabled DNT signals or similar mechanisms.

Law and Protection

We may collect, use, preserve, and share your information if we have a good-faith belief that it is reasonably necessary to: (a) respond pursuant to applicable law or regulations, to legal process, or to government requests; (b) enforce our Terms and any other applicable terms and policies, including for investigations of potential violations; (c) detect, investigate, prevent, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our users of our Services or the public from harm or potentially prohibited or illegal activities.

Your Permission

You agree to our information practices, including the collection, use, processing, and sharing of your information as described in this Privacy Policy, as well as the transfer and processing of your information in other countries globally where we have or use facilities, service providers, or partners, regardless of where you use our Services. You acknowledge that the laws, regulations, and standards of the country in which your information is stored or processed may be different from those of your own country.

Security

We take reasonable measures, including administrative, technical, and physical safeguards, to protect your information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. We temporarily hold information about you at our own premises and permanently store it electronically with the assistance of third-party service providers. We restrict access to personal information to those Buymore employees, contractors, and agents who need to know that information in order to transmit, store, or process it, who are subject to contractual confidentiality obligations consistent with this Privacy Policy, and who may be disciplined or terminated if they fail to meet these obligations. Our third-party service providers store and transmit personal information in compliance with this Policy and other appropriate confidentiality and security measures.

Nevertheless, Buymore cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. In the event that any information in our possession or under our control is compromised as a result of a security breach, we will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take other steps in accordance with applicable laws or regulations.
